Trial of Ryan Cummings

Ryan Cummings, the driver who caused the death of J Raymond Brown and Jim Barrette on Jan. 18, 1999, was scheduled (finally) to go to trial today, July 24, 2001....
Cummings is charged with 2 counts of vehicular homicide and 1 count of reckless driving.

Ryan Cummings pled no contest to all three counts. He received 3 years prison with 7 years probation. No driving at all during that 10 years. He was given one week to put his affairs in order. Next Wednesday he will be remanded into custody.
Please excuse my oversimplification and lack of legal terms...
The maximum penalty would be 11 years in prison. But this is highly unlikely, because criminals who shoot people with a gun sometimes get 11 years.
Mark Grahm, the prosecutor, related to us that C's lawyer asked him last Friday to let him plead guilty with a reduced sentence (just local jail time, no state jail time and not losing his driver's license for driving to work.) The DA refused.
Monday morning, C's lawyer asked the DA to ask the families if they could accept reduced state jail time then still drive for business. Since the wreck happened when C was driving to work, the DA refused. Monday afternoon the DA contacted us and told us quite a bit of information we hadn't heard before. I'll write it below.
Anyway, Tuesday morning, (This is happening while I write this.) the DA, Ryan Cummings and his lawyers will go before the judge to sort of work out a plea arrangement. The family has the legal right to be present.
John Barrett, Jill, Rodney, and Janice and James were all there, and several spoke regarding the sentence. James Jr.'s talk was so beautiful that the two court stenographers were crying.

mmmmmmm..... skiing. Owen and I (and a few of our friends) went to mount baker yesterday. It was a sunny day and there was a 44 inch base and 4 inches of new powder. I can't wait for the rest of the season.
